Owner agreement
What you agree when you lease your car to us for rental, or sell it through us.
Draft. This text is being reviewed by a lawyer and may change before we launch. Parts in [square brackets] are still to be filled in.
1. The parties and what this is
This agreement is between [COMPANY LEGAL NAME], [RC NUMBER], of [ADDRESS] ("we", "us") and you, the person or company who signs up as an owner ("you"). It covers each car you add. We do not own cars: we rent out, or help you sell, cars that you own.
2. Your promises about the car
- You own the car, or are legally allowed to rent it out or sell it, and no one else has a claim on it that would stop this.
- Its papers are genuine and current: registration, proof of ownership, [customs papers], roadworthiness, and (for rentals) insurance that covers [hire and reward]. You must keep them valid and upload the new ones when they renew.
- The car is safe to drive and matches the description and photos you gave. You tell us about known faults and accidents.
3. Renting your car out
- You choose the dates your car is available (a week, a month, longer). We rent it only inside those dates. You may add or end a period, but not cancel a rental that has already been booked.
- We list your car at the airport you chose, take bookings and payments, check the renter's licence, hand the car over and take it back.
- **Your share:** for each completed rental you receive [60]% of the rental price (before the deposit and extras that are not yours), after the renter has paid. Our share is [40]%. If a partner business sold the rental, your share is still [60]%: the partner's commission comes out of our share.
- **Payment:** your earnings become available after the rental is completed and are paid to your verified bank account in a payout run [weekly / on request]. We pay only into an account whose name matches yours, as confirmed by the bank.
- Nothing is owed on either side for days when no one rents the car.
4. Care, damage and insurance
- Between hand-over to a renter and its return, [the renter is responsible for the car, under their rental terms]. While the car is parked or in our care, we are responsible for [describe].
- [Describe insurance: who insures, what is covered, the excess, what happens in theft, accident or total loss, and how and when you are paid.]
- We inspect and photograph the car at every hand-over and return. If it comes back damaged, we recover from the renter's deposit and [insurance]. You will see the report. [State the time limit for claims.]
- You must not use the car yourself, or let anyone else, during a booked rental.
5. Taking your car back
- You may withdraw the car from rental at any time, except from rentals already booked, which must be completed. To end it, [tell us and remove the dates]. [State any notice period.]
- We may suspend a car if its papers expire, it is unsafe, or we suspect a problem. We tell you why.
6. Selling your car through us
- You set the price. We check the car and its papers and list it. A buyer reserves it with a deposit, then pays the balance into escrow. Money is held until the buyer has the car and papers.
- **Your share:** you receive [94]% of the sale price when the hand-over is confirmed. Our fee is [6]%.
- You must hand over the car, keys and papers, and cooperate with the transfer of ownership. If you cannot, or the papers are not genuine, the buyer is refunded, and [state any consequence for you].
- While a car is reserved or sold you must not offer it to anyone else.
7. Checking who you are
- We may ask you to prove your identity, with your agreement, including through a virtual NIN, and we may refuse or end this agreement if we cannot be satisfied about your identity or your car. How we handle that data is in our privacy policy.
8. Your account
- Keep your password safe. Tell us at once if someone else may have it. What happens under your account is your responsibility.
- Tell us if your phone, email, or bank details change. We email and text you when your payout account is changed.
9. Ending this agreement
- You may close your account when you have no booked rentals, open sales or unpaid claims. We may close it if you break this agreement or the law. What you have already earned is still paid.
10. What we are not responsible for
- Loss caused by things outside our control. We do not promise that your car will be rented or sold, or earn any amount. Examples on our website are estimates, not promises.
- [Limit of our liability — to be written by your lawyer.]
11. Changes, law and disputes
- We may change this agreement; we will tell you before a change that affects your share or fees, and it will not change a rental already booked. This agreement is governed by the laws of the Federal Republic of Nigeria. Disputes go to [the courts of Nigeria / arbitration in Abuja or Lagos].
